Payment Rule Waivers

MSSP ACO Participation Waiver Disclosure

The Secretary of the U.S. Department of Health and Human Services has provided waivers of certain federal fraud and abuse laws that may otherwise limit innovation by ACOs participating in the Medicare Shared Savings Program ACO Model (see “Final Waivers in Connection With the Shared Savings Program” (80 Fed. Reg. 66,726 (Oct. 29, 2015))). Pursuant to that notice, Froedtert & The Medical College of Wisconsin ACO, LLC (“FMCW ACO”) seeks waiver protection for the arrangement described below:

FMCW ACO has entered into a dementia care management program agreement (the “Agreement”) with Ceresti Health, Inc. (“Ceresti”) pursuant to which Ceresti will provide care management, coordination and caregiver education and support using its technology-enabled caregiver-enabled dementia program to assist with the care of patients diagnosed with dementia in order to improve the quality and coordination of care for certain Medicare beneficiaries with dementia assigned to FMCW ACO. The Agreement was effective as of Aug. 1, 2025. (Posted Aug. 5, 2025)
